ZekCloud (zekcloud.com, hereinafter referred to as “we” or “ZekCloud”) operates an Apple Silicon bare-metal cloud compute platform. This policy explains how we collect, use, store, share, and protect information related to you. By registering an account, visiting the website, or using any ZekCloud services, you acknowledge that you have read, understood, and agreed to all contents of this policy.

I. Scope of information collection

To provide, maintain, optimize, and operate our services in compliance, we may collect the following information (including but not limited to):

Your data is stored in Singapore, Japan, Korea, Hong Kong, US West, and other data centers we select. After service expiry, account cancellation, or termination due to violations, we may retain your account and transaction records within a reasonable period (usually no more than 30 calendar days; in special cases up to 180 days) for compliance audits, dispute handling, and legal obligations. After that, we may permanently delete user data on servers, and do not guarantee data recoverability. Users should complete all data backups before service termination. ZekCloud bears no responsibility for data loss caused by failure to back up in time.

When reclaiming physical nodes, we perform standard disk erasure procedures; however, due to technical limitations, hardware failures, or user-side encryption, we do not guarantee that data has been completely and irreversibly erased

In the following circumstances, we may share your information with third parties without separately obtaining your consent:

Exceptions include: information related to unpaid bills, ongoing disputes, compliance retention obligations, or anti-fraud investigations; and data that has been anonymized or aggregated and cannot identify a specific individual. We will respond within a reasonable period (usually no more than 30 business days) and may charge reasonable fees or refuse clearly repetitive or out-of-scope requests. ZekCloud reserves the final right of interpretation regarding request handling results.

ZekCloud services are intended for natural persons aged 18 and above, or legally established entities. We do not knowingly collect minors’ personal information. If we discover inadvertent collection, we will delete it as soon as possible and assume no liability arising from it.

Welcome to ZekCloud (zekcloud.com) Apple Silicon bare-metal cloud compute services. These terms constitute a legally binding agreement between you and ZekCloud. By clicking “Sign Up” or “Purchase” or by using the service, you acknowledge that you have read, understood, and agreed to be bound by these terms. If you use the service on behalf of an organization, you represent and warrant that you have obtained full authorization from that organization.

I. Service description

ZekCloud provides users with remote rental services for Apple Silicon physical servers such as Mac mini M4, including but not limited to SSH remote terminals, VNC remote desktops, dedicated public IPs, bandwidth quotas, and a management console. The final configuration, pricing, and available regions are subject to the order confirmation page and console display. We reserve the right to adjust product specifications, pricing, available inventory, and service scope at any time, without prior notice

Services are provided on an “AS IS” and “AS AVAILABLE” basis. ZekCloud makes no express or implied warranties regarding continuity, stability, latency, throughput, compatibility, or error‑free operation of the services.

II. Account registration and security

Users must register accounts with a real and valid email address and bear full legal responsibility for all actions under their accounts. Users are obligated to keep login credentials secure. ZekCloud is not liable for any loss caused by user negligence, account sharing, weak passwords, or compromised devices. If abnormal usage is detected, users should notify us immediately, but we are under no obligation to suspend services or restore data as a result.

Each natural person or legal entity may in principle register only one primary account. We reserve the right to refuse registration, freeze, or cancel any account without providing a reason.

ZekCloud is committed to providing stable and reliable infrastructure, but does not make any commitments regarding service-level agreements (SLA). ZekCloud is not liable for service interruptions, performance degradation, or data unavailability caused by scheduled maintenance, emergency fixes, hardware replacement, network congestion, DDoS attacks, power failures, natural disasters, third‑party outages, or any other cause (including factors within or outside ZekCloud’s control), and will not provide service‑time compensation or fee reductions.

We may perform system maintenance, upgrades, migrations, or resource reallocation without notifying users in advance; any brief interruptions arising therefrom are deemed normal operational behavior.

Users may not use ZekCloud services to engage in any of the following, including but not limited to:

If we discover or reasonably suspect any of the above behaviors, ZekCloud has the right to immediately suspend or terminate services, block IPs, permanently close accounts, and confiscate account balances without refund, and reserves the right to report to authorities and pursue legal responsibility. Users will bear all consequences arising therefrom.

VI. Data and content

Users are solely responsible for all data stored, processed, or transmitted on ZekCloud servers (“User Content”). ZekCloud does not review the legality, accuracy, or security of User Content (unless required by law) and assumes no responsibility for it. After service expiry or termination, user data may be deleted immediately, and ZekCloud has no obligation to retain data or provide export services. Users must complete their own backups during the service term.

VII. Intellectual property

All intellectual property rights in the ZekCloud platform, website, console, APIs, documentation, trademarks, logos, and related technologies are owned by ZekCloud or its licensors. Users are granted only a limited, non‑exclusive, non‑transferable, non‑sublicensable right to use the services during the paid term in accordance with these terms. Without written authorization, users may not copy, modify, reverse engineer, decompile, or create derivative works from them.

To the maximum extent permitted by applicable law:

ZekCloud may modify, suspend, or terminate part or all of the services at any time without prior notice or user consent and without any liability for compensation. Users may request termination via the console, but fees already paid are non‑refundable, and unused time will not be converted to cash. X. Dispute resolution

The interpretation, validity, and dispute resolution of these terms shall be governed by the laws of ZekCloud’s place of registration (Singapore law). Any dispute arising out of or in connection with these terms shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the Singapore International Arbitration Centre (SIAC) for arbitration in accordance with its then‑effective rules, with the seat of arbitration in Singapore and the arbitration language being English. The arbitral award shall be final and binding on both parties. Users waive the right to resolve disputes through class actions, representative actions, or jury trials.

XI. Amendments to the terms

ZekCloud reserves the right to revise these terms at any time. Revised terms take effect from the date of publication on zekcloud.com, and continued use of the services constitutes acceptance. If you do not agree to the revisions, you should stop using the services and cancel your account; fees already paid will not be refunded.
